What is "Provisional Release"?

The provisional release system under Japan’s Immigration Control and Refugee Recognition Act is a framework that allows certain foreign nationals, who are under deportation procedures or in detention, to be temporarily released under specific conditions. It is generally applied for humanitarian reasons, health concerns, or practical needs in daily life. When granted, the individual is permitted to live outside the detention facility while their immigration case or refugee application is being processed.

However, provisional release comes with strict conditions. The individual must declare their place of residence, refrain from traveling outside designated areas, and report regularly to immigration authorities. In addition, employment is prohibited, which often makes it difficult for released individuals to secure stable living conditions without support from family, friends, or aid organizations. Failure to comply with these conditions may result in being taken back into detention.

This system was introduced to mitigate the human rights issues associated with indefinite detention, but life under provisional release still involves many restrictions and uncertainties. While it represents a balance between humanitarian considerations and immigration control, the system has been subject to ongoing debate. For foreign nationals seeking stability and dignity in Japan, further reforms and improvements are often called for.
