The Trump administration has proposed a new fee of about $103,000 for employers sponsoring most new H-1B visa holders, after a federal court struck down its earlier $100,000 fee as an unauthorized tax. The new proposal would use the regulatory process and could raise about $8.8 billion to fund immigration administration and enforcement.

The administration argues that the fee would discourage companies from hiring lower-cost foreign workers instead of qualified Americans and help protect U.S. wages and jobs. Visa renewals and workers sponsored by certain hospitals, universities and nonprofit organizations would generally be exempt.

Critics warn that such a high fee could effectively shut down much of the H-1B pipeline, reducing access to skilled professionals in technology, medicine and finance. They also fear that talented workers and international students will increasingly choose Canada, Europe and other countries, accelerating a U.S. “brain drain.”

The proposal is part of the Trump administration’s broader tightening of legal immigration, which has also included favoring higher-paid H-1B applicants and proposing higher minimum wages for visa holders.
