Canada’s Immigration, Refugees and Citizenship Canada (IRCC) has issued new guidance confirming that refugees applying for resettlement are not required to provide an exit permit or proof of legal status in their host country in order to process their permanent residence applications. Under the Immigration and Refugee Protection Act (IRPA), the inability to obtain such documents cannot be used as grounds to refuse a refugee resettlement application.

The guidance recognizes that many refugees live in countries where exit permits are required but difficult or impossible to obtain due to factors such as lack of legal status or high administrative fees. IRCC officers may therefore continue processing and approve applications if all other program requirements are met, even when the applicant cannot secure permission to leave the host country.

When applicants face barriers to departure, IRCC provides three possible options: the applicant may voluntarily withdraw the application, the file may be temporarily placed on hold if the situation is expected to improve, or the application may proceed to final approval with a permanent residence visa issued. However, if the applicant cannot leave before the visa expires, the application will close and a new application will be required.

In exceptional circumstances involving threats to life or safety, refugees may also choose to reclassify family members who cannot leave the host country from “accompanying” to “non-accompanying” dependents. This allows the principal applicant to travel to Canada first, while attempting family reunification later through programs such as the One-Year Window provision or Family Class sponsorship, although approval is not guaranteed.
