Summary: The U.S. Department of State has issued new rules requiring foreign nationals to apply for U.S. nonimmigrant visas only in their country of nationality or residence. This ends the long-standing practice of third-country national (TCN) visa processing in Canada. Applicants from countries without U.S. visa services must now apply at designated consulates. Existing appointments remain valid, but visa fees are non-refundable and non-transferable if an application outside the permitted location is refused. Limited exceptions exist for diplomatic, humanitarian, or medical cases. Employers should anticipate disruptions, longer processing times, and the need for employees to travel back to their home countries for visa applications.

Meanwhile, Sweden has proposed major reforms to its family immigration system, set to take effect on January 1, 2027. The proposal introduces ongoing financial maintenance requirements, different conditions depending on the sponsor’s status (citizen, permanent resident, or temporary resident), and narrower definitions of eligible family members, particularly for temporary residents and labor migrants. Some applicants may face a two-year waiting period before applying, while children may be granted exceptions. Stricter background checks, including on individuals with a history of domestic violence, are also proposed. These changes are intended to create a more structured and sustainable system but will increase the complexity and restrictiveness of family reunification for both applicants and employers.
