New Zealand’s new Skilled Migrant Category (SMC) rules place greater emphasis on whether an applicant’s actual work substantially matches the relevant ANZSCO occupation, particularly for red and amber list roles such as chefs, restaurant managers, hotel managers and retail managers.

A job title or generic job description alone is insufficient. Immigration New Zealand (INZ) may examine actual daily duties, workplace structure, employer size and the applicant’s genuine level of managerial control or specialist responsibility. Past appeal cases show that managers in franchises or large organisations may fail to qualify when key decisions remain with head office or other staff. Conversely, some chefs and hotel or restaurant managers successfully challenged refusals when INZ failed to properly consider their real responsibilities and workplace context.

The cases demonstrate that applicants need detailed, context-specific evidence showing how their duties and authority correspond to ANZSCO requirements. With residence application fees approaching NZ$6,000, careful preparation is particularly important under the new rules.
