The Trump administration has asked the U.S. Supreme Court to allow the removal of a group of Venezuelan migrants detained in Texas using standard immigration laws, rather than the controversial 1798 Alien Enemies Act, while legal challenges over that wartime law continue.
Earlier, the Supreme Court temporarily blocked the removal of these migrants but did not specify whether it was halting deportations under the Alien Enemies Act or other laws. In response, the Justice Department argued that the court should allow removals under the Act, but also requested clarification that the administration can proceed using other, less controversial immigration statutes.
The American Civil Liberties Union (ACLU) had filed a lawsuit after the migrants received removal notices under the Alien Enemies Act, arguing that the government might be bypassing due process protections, including habeas corpus. Although lower courts denied the ACLU’s request, the Supreme Court issued a temporary stay on the deportations. The administration’s latest filing adopted a more restrained tone than in previous briefs, likely in recognition of the Supreme Court’s unusual intervention.
