Judge halts new Florida immigration law, says enforcement is federal responsibility

Summary
A Miami-based judge, Kathleen Williams, issued a temporary restraining order against Florida's SB 4-C law, which criminalizes undocumented immigrants entering or re-entering the state. The law was approved by the Republican-controlled legislature and Governor Ron DeSantis in February. The plaintiffs, including the Florida Immigrant Coalition and the Farmworker Association of Florida, argued that the law violates the Supremacy Clause of the U.S. Constitution, as immigration enforcement is a federal responsibility. Williams agreed, stating that the law unlawfully encroaches on federal powers and limits federal discretion in handling immigration cases. She also highlighted how the law imposes mandatory prison sentences, contrasting with federal laws that may allow fines or probation for similar offenses.
The court’s decision is based on the Supremacy Clause but also considers the plaintiffs' arguments regarding violations of the Commerce Clause. A hearing for a preliminary injunction is scheduled for April 18, which could block the law while the case proceeds. The lawsuit was filed by the ACLU and other advocacy groups, and Florida has yet to file arguments in response.
