The Trump administration aggressively publicized the arrests of over 8,000 immigrants since Inauguration Day, promising these arrests would be part of a historic mass deportation. However, some of those detained have been released back into the U.S. under a monitoring program due to space limitations in ICE detention facilities and federal court rulings that prevent indefinite detention. The released individuals are monitored using ankle monitors, wrist bands, or phone check-ins.
Although Trump’s "catch-and-release" ban is in effect at the southern border, ICE’s limited detention capacity (41,500 beds) has led to some interior detainees being released. ICE prioritizes detaining individuals deemed public safety threats and uses discretion for those without serious criminal convictions. Certain detainees, including those from countries refusing to accept deportees, may also be released if they are not considered threats. Some are released for medical reasons or if they are the sole caretakers of children.
