Employers, particularly in industries like manufacturing, food processing, agriculture, construction, and hospitality, should prepare for intensified immigration enforcement in the workplace. Many businesses may have unknowingly employed unauthorized workers, and while the E-Verify system is available, it does not always catch fake documents.
The U.S. Department of Homeland Security (DHS) can audit companies by reviewing I-9 forms and other employee documents, issuing fines for non-compliance, or identifying unauthorized workers. In some cases, DHS may conduct large-scale raids, leading to the loss of workers and potentially seizing business assets like computers and documents. Employers may face criminal charges for knowingly hiring unauthorized workers, which could result in substantial fines and imprisonment.
To prepare, businesses should audit I-9 records, enroll in E-Verify, ensure tax and payroll compliance, and establish a clear immigration compliance policy. They should also designate a response team and plan for potential raids or inspections.
