Summary
President-elect Donald Trump's promise to initiate mass deportations has raised concerns in industries like construction that rely heavily on immigrant workers. According to the Pew Research Center, 26% of construction workers are immigrants, with 13% being unauthorized. Even companies employing only documented workers are worried about increased scrutiny.
Many construction firms have begun conducting internal I-9 audits to ensure their workforce is authorized to work in the U.S. The I-9 form verifies a worker’s eligibility and must be completed within three days of hiring. However, some companies may not be fully aware of their undocumented workforce due to lack of communication between managers and HR.
In addition to I-9 forms, 23 states require the use of E-Verify, a more detailed program for confirming eligibility. However, internal audits can disrupt workers, even those with work authorization, potentially leading to layoffs or discrimination claims. While audits are increasing, companies must be cautious not to inadvertently discriminate or create unnecessary fear among workers, as this can impact workplace performance and safety.
